Man sentenced to 35 years in prison after having a shootout with an East Rochester police officer

A judge sentenced Raymond Noel, 52, to 35 years to life in prison for the Jan. 14, 2024 shooting.

Officers Brad Steve and Kyle Walsh responded to a 911 call of "cause unknown" just before 3:40 p.m. at an apartment on Garfield Street.

Video appeared to show Steve encountering Noel in a driveway, with Noel walking away and refusing commands to remove his hands from his pockets as he entered a home and attempted to close the door.

Steve then appeared to open the door quickly and order Noel back out, yelling "Don't reach for that!" followed by gunshots as Steve retreated.

Police said Steve fired his gun, striking Noel in the upper torso, with Noel firing multiple shots in return and hitting Steve in his bulletproof vest. Both Steve and Noel had non-life-threatening injuries.

"I commend Officers Brad Steve and Kyle Walsh for their courage and professionalism under extraordinarily dangerous circumstances," East Rochester Police Chief Michael Brandenburg said in a statement. "This outcome is a testament to their dedication to public safety."

“This incident could have ended peacefully, but instead the defendant chose to point his illegally possessed firearm at an experienced police officer whose life was in imminent danger," Assistant District Attorney Michael Harrigan said in a statement. "Today’s life sentence is a much-needed resolution for Officer Steve and the entire law enforcement community."

Officer Steve was present in court as Noel received his sentence.

"It's not anything that anybody ever wants to deal with," said Steve. "It's not...in law enforcement, something we go out on a shift, and we want to be involved in, and it's not anything I wish on my worst enemy."

A jury convicted Noel of attempted aggravated murder, attempted aggravated assault upon a police officer, and two counts of criminal possession of a weapon Nov. 26.
